Overview

We require all families to log in to their Portal to accept Terms and Conditions as a family and for each student every year. When the policy is accepted through the Portal it will capture the date, email and IP address. All policies must be accepted to participate in lesson with the exception of the photo waiver.

Family Policies

Billing Authorization

I represent and warrant that if I am purchasing something or paying for a service from this facility or from other merchants through this facility that (i) any credit/debit card information I supply is true and complete, (ii) charges incurred by me will be honored by my credit card company or financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties.

I hereby authorize (if online payment is made or autopay information is provided) this facility to charge my credit/debit card account. I understand that my authorization for automatic payments will remain in effect until I submit a drop/cancel notice through my Customer Portal revoking this authorization and HFSS has a reasonable opportunity to act on my notice.  Minimum notice requirements vary by program and are posted on the HFSS website.  I understand I am responsible for payment whether or not my student attends classes until I submit my drop/cancellation for my student from enrollments.

Should I dispute a charge through my financial institution this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services.

If my payment fails and is not corrected within 24 hours HFSS reserves the right to drop my enrollment.

 
 

Drop/Cancellation Policy

I MUST NOTIFY HFSS TO DROP MY STUDENT FROM CLASS.

I understand that my swimmer is enrolled continuously until I submit a drop notice through my Customer Portal. Minimum notice requirements vary by program.  See website FAQ for more information.

I am responsible for payment for my student's classes WHETHER OR NOT MY STUDENT ATTENDS CLASS.

If my student stops coming to class my card will continue to be charged until I submit a drop/cancel notice through my Customer Portal revoking this authorization and I have provided a reasonable opportunity for HFSS to act on my notice.  This charge will be for holding my student's place in that class instead of offering that place to another student.

 
 

Waiver

As the parent or legal guardian of my designated student(s) (student(s)),I hereby consent to all student(s) participating in the Hubbard programs, including, but not limited to Swim Lessons, Clinics, Swim Squads/Teams, and hereby assume full responsibility for all risks of injury or loss which may result from my son's/daughter's participation in this activity and hereby agree to hold harmless, release and forever discharge Hubbard, it's officers, agents and employees from and waive any and all claims and demands whatsoever which the undersigned and any of them or any third person of any accident, illness, injury, or death of any person and persons, or damage to or loss or destruction of any property arising or resulting from swimming and/or a variety of strenuous exercise, vigorous physical activities and/or running directly or indirectly from my son's/daughter's participation in the aforementioned program and occurring during said participation or any time subsequent thereto, save and except that the above provisions shall not be applicable to injury to or death of persons, or damage to or loss of property arising out of the sole negligent acts or omissions of Hubbard, their officers, agents or employees. The terms of this release shall serve as a release and assumption of risk for my son(s)/daughter(s), heirs, executors and administrators and for all my family members.

I understand, agree, and acknowledge that there are risks in the sports activities conducted by the Hubbard Family Swim Schools, including, but not limited to paralyzing injuries, brain injuries, and death. These activities may be of a hazardous nature and/or may include activities such as swimming, a variety of strenuous exercise, and vigorous physical activities. With the full understanding of the facts, I state that, to the best of my knowledge, my son(s)/daughter(s) listed on my account has no medical, physical, mental or emotional health condition which would hinder or prevent his/her active participation in Hubbard programs.

 
 

Student Policies

Emergency Medical Treatment

In the event of a medical emergency, I hereby grant authorization to the Hubbard Family Swim School, and its representatives, to employ any legally licensed physician or health care facility on behalf of each of the undersigned, and to direct and/or order emergency medical treatment for this participant. I also agree that neither Hubbard nor any of its representatives, shall be liable under any circumstances to anyone for exercising the foregoing authority in the event of an emergency.

 
 

Instructor Expectations

While we take every effort to maintain instructor consistency,  instructors are subject to change without notice.  If an instructor is out due to illness or vacation we do our best to provide an equal substitute.  We take illness and signs of COVID seriously and ask our instructors to not come to work if they are displaying any symptoms for the protection of our families.

Instructors also have the potential to change seasonally.  Many of our instructors are students or parents and we allow for schedules to change based on school or life changes in January, End of May, Beginning of August.

 
 

Makeup Policy

I understand…

  • My swimmer must be in a qualifying program to receive a Makeup Token (MUT). (See website FAQ for full list & details)
  • I must mark my swimmer absent before the start of class to receive a MUT.
  • MUTs hold no financial value and are non-transferable.
  • Class availability cannot be guaranteed as it is based on vacancies, and my swimmer’s age & level.
  • Once scheduled, Makeups cannot be rescheduled, made up if missed or issued a new MUT.
  • My swimmer must be currently enrolled in year-round lessons to redeem a MUT.
  • MUTs expire 12 months from the date issued.
  • New swimmers, returning swimmers and newly promoted swimmers must complete 4 regularly scheduled lessons before scheduling a makeup.
 
 

Photo Waiver (Optional)

I understand that Photos and Videos (herein and after collectively "Images") are occasionally taken at Hubbard Family Swim School ("HFSS") facilities and that any Images taken of myself or my minor child may be used. I hereby give HFSS my permission to license the Images and to use the Images in any Media for any purpose (except pornographic or defamatory) which may include, among others, advertising, promotion, marketing or packaging for any product or service. I agree that the Images may be combined with other images, text and graphics, and cropped, altered or modified.

I agree that I have no rights to the Images, and all rights to the Images belong to HFSS. I acknowledge and agree that I have no right to Consideration or accounting, and that I will make no claim for any reason to HFSS.

 
 

Transaction Policies

One Time Payment Disclosure

By providing my credit card, or debit card information, I authorize Hubbard Family Swim School to charge my account for the agreed upon purchases and/or services.

If Hubbard Family Swim School is unable to secure funds from my credit/debit card(s) or my bank for any reason, including, but not limited to, insufficient funds in my credit/debit card or insufficient or inaccurate information provided by me when submitting my electronic payment, Hubbard Family Swim School may undertake further collection action.

 
 

Recurring Payments Policy

By providing your debit card, or credit card information, you certify that you have the authority to authorize debits or charges to the payment information identified here and you authorize Hubbard Family Swim School to electronically debit or charge the payment information on a recurring basis in the amount due on or after the due date for your payment.

Initial booking balances are due at the time of enrollment. Monthly tuition is due on the 1st business day of the month. If your payment fails, you will be notified via an automated email sent to the email address on file with directions on how to complete your payment. HFSS reserves the right to cancel accounts with unpaid balances if payment is not received by the due date.

Your authorization will remain in effect until you submit a drop/cancel notice through your Customer Portal and we have a reasonable opportunity to act on your notice.

You may print this authorization or store it electronically and keep it for your records.

 
 

Returns, Refunds, and Cancellations Policy

All sales are final. Because classes have limited openings and are reserved for as long as you are enrolled, there are no refunds for any classes missed.

Your authorization for automatic payments will remain in effect until you submit a drop/cancel notice through your Customer Portal revoking this authorization and we have a reasonable opportunity to act on your notice.

We update and have families accept policies every year as a refresher to what they have agreed to.
